Profound Research LLC (hereafter, “Profound,” the “Organization,” “we,” or “us”) is committed to protecting the privacy of our online guests, users, staff, members, and friends through our compliance with this policy (the “Privacy Policy”). This Privacy Policy additionally describes our practices for collecting, using, maintaining, protecting, and disclosing that information.

When you use our Site, request information about our business, apply for a job, submit forms or send email to our company, including inquiries regarding clinical studies, research, or business opportunities, or when you participate in a clinical trial managed by Profound (as a service provider, clinician, administrator, or data subject), you agree and consent to our collection, use, disclosure, storage and transfer of information as described in this policy, so please review it carefully.

Information We Collect or Receive

We only collect, use, share, store, or otherwise process your personal information when we have an appropriate basis. For example, we may process your personal information as necessary to facilitate our business, including processing a job application, responding to your inquiry, or facilitating your participation in a clinical trial. We may also process your personal information to comply with legal obligations, such as regulatory requirements, or for other purposes of pursuing legitimate interests. We only process your personal information if doing so is consistent with your rights and appropriate to the context, such as providing products, services or information you have requested, responding to your questions or concerns, evaluating an employment application, and conducting reasonable monitoring of our Site to prevent misuse and fraud. In some cases, we may ask you for your consent for processing of your personal information, such as when you sign a contract, apply for a job serve as an investigator, or participate in a clinical trial as a data subject. In those cases, we may process your personal information for any purpose disclosed to you at the time you provided your consent for such processing. If you specifically consented that Profound process your personal information in a manner that is inconsistent with or beyond the scope of these terms or if you executed a contract or signed an informed consent document related to a Profound clinical trial, where the provisions of such contract or consent conflict with the terms of this policy, the terms of your specific consent, the contract or informed consent document shall control.

This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). This Privacy Policy applies to information we collect:

  • On this Site;
  • In email, text, and other electronic messages between you and the Organization;
  • When you interact with Profound or our advertising and applications on third-party websites and services, if those applications or advertising include links to this Privacy Policy.

Children under the age of Thirteen and other Minors

Our Site is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 13 through the Site. If you are under 13, do not use or provide any information on this Site or through any of its features, use any of the interactive or public comment features of this Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.   • Report a problem with our Site;
  • Subscribe to Profound newsletters or email notifications;
  • Submit inquiries about participating in clinical trials, whether as a patient or investigator;
  • Participate in a Profound clinical trial;
  • Report adverse events; and
  • Contact us for any reason, such as by email (including email sent through our Site or otherwise using Profound email addresses).
  • Automatically as you navigate through the Site, such as your: 
  • Usage details;
  • IP addresses, geographical location and identification of your computer, mobile phone, or other device;
  • Mobile carrier, computer, internet connection, operating system, browser type, and version numbers;
  • Bandwidth use and system and connection performance;
  • Length of visit and page views;
  • Referral source;
  • Information collected through cookies, web beacons, and other tracking technologies, as below.
  • Cookies (or browser cookies). Information about you plays a key role in our ability to serve you. Amongst other things, it helps us understand your need and effectively promote the Organization. For example, we use information about you to:

  • Respond more accurately and efficiently to your requests;
  • Identify opportunities for you in employment, clinical research, and otherwise;
  • Develop services that may benefit you;
  • Provide you with information you request from us;

Sensitive information

In no circumstance will we process sensitive personal information about you, such as information about your health, race, ethnicity, national origin, political opinion, religious or philosophical beliefs, trade union membership, genetic data, or information about your sexual orientation or sexual life without your consent.

Email Communications

We may send email newsletters to our Site visitors who have provided us with their email address to provide information about events, developments, and various other activities we think might be of interest to them. Email recipients may always opt out of any email category at any time by following the unsubscribe instructions included in the email message.

Emailing Profound

We try to respond to email messages requiring a response in accordance with our internal policies. State Privacy Rights

To the extent you wish to exercise privacy rights afforded to residents of the state in which you live, please contact us by email at legal@profoundresearch.io.

  • California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to legal@profoundresearch.io.
  • Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to: 
  • Confirm whether we process their personal information;
  • Access and delete certain personal information;
  • Data portability; and
  • Opt-out of personal data processing for targeted advertising and sales. Colorado, Connecticut, and Virginia also provide their state residents with rights to:
  • Correct inaccuracies in their personal information, considering the information’s nature processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.
  • Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address.

Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Opt-Out Policy

We may at times send you email communications with informational or promotional materials. If you prefer not to receive such marketing or promotional emails from us, you may unsubscribe completely by emailing us at DataRequests@ProfoundResearch.io.  Profound strives to respond and/or process opt-out requests within seventy-two (72) business hours, when practicable.  Please also note that at times we may need to send you email communications that are transactional in nature such as service or termination announcements or payment confirmations which are communications you will not be able to opt-out of.

If you would like us to remove your Personally Identifiable Information from our database, please send a request to: DataRequests@ProfoundResearch.io . We are not responsible for removing your personal information from the lists of any third-party services or other third party who has previously been provided your information in accordance with this notice.

Applicable Law and Jurisdiction

This Privacy Notice shall be governed by, construed and entered in accordance with the laws of the State of Tennessee applicable to contracts deemed to be made within such state, without regard to the choice of law or conflict of law provisions thereof. All disputes with respect to this Privacy Policy shall be brought and heard either in the state or federal courts of proper jurisdiction located in Davidson County Tennessee. You consent to the in personam jurisdiction and venue of such courts. YOU HEREBY WAIVE YOUR RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY CLAIM, ACTION OR PROCEEDING, DIRECTLY OR INDIRECTLY, ARISING OUT OF, OR RELATING TO, THIS AGREEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.

Changes to this Privacy Policy

Profound reserves the right to amend this Privacy Policy to reflect changes to Profound’s lines of business and service offerings, advancements in technology, and changes to legal and regulatory requirements, as well as good business practices. If Profound changes this Privacy Policy, an updated version will reflect those changes and will be posted to the Site and with an updated effective date. Unless we say otherwise in our notice, the amended Privacy Policy will be effective immediately, and your continued use of our Site after we provide such notice will confirm your acceptance of the changes. You agree to accept posting of a revised Privacy Policy as described herein as actual notice to you of such revised Privacy Policy. Your continued use of our Site after such posting constitutes consent to the collection and use of your information as described in the then-current Privacy Policy.
